Personal Data

The personal data we collect from all data subjects is in line with the requirements of the General Data Protection Regulation Act 2018. Our Data Protection Officer is Ian MacInnes. Who are we?

D&A Munn Ltd are an independent firm of funeral directors providing funeral services. We are a member of the National Association of Funeral Directors (NAFD) and the National Society of Allied and Independent Funeral Directors (SAIF) and subscribe to their current Code of Practice.

Our offices are located at 4 Breadalbane Street, Oban, Argyll, PA34 5NZ, Company Registration number SC319405.

In what capacity will D&A Munn Ltd Funeral Directors hold your personal information?

Most of the personal information we process is provided to us directly by you in relation to arranging a funeral for a loved one, purchasing a pre-paid funeral plan or other funeral related services.

In providing our services, we will act as both a Data Controller (whereby we are responsible for deciding how we hold and use your personal information) and Data Processor (whereby we are responsible for processing your personal information) in respect of your personal information.

We will use your personal information where it is:

• For the fulfilment of your request to conduct a funeral
• To enable future contact regarding cremated remains; fingerprints, jewellery or personal effects collection
• To enable future contact regarding pre-payment plans or invitation to leave a client review of our service to you

Our legal basis for processing your personal data is as follows:

• Fulfilment of a contract
• Continued support

Any legitimate interests pursued by us, or third parties we use, are as follows:

• For the fulfilment of the funeral service
• Continued support
• To enable future contact regarding pre-payment plans, client reviews or other funeral related services

How do we collect information from you?

We collect the personal information directly from you or in some cases from a third party. It is obtained using the following methods:

• In person
• By telephone, text message, Messenger or What’sApp
• Via electronic formats i.e. PDF attachment to an email or within the body of an email
• Through our website enquiry form
• Through the post

What type of information do we collect from you?

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We will collect, store, and use the following categories of personal information about you or the deceased person in our care:

• Full name and title
• Contact information (i.e. home or correspondence address, email address, telephone numbers)
• Date of birth
• National Insurance Number
• Financial details (i.e. bank account details)
• Identification documents (i.e. copy passport or driving licence)
• Proof of address documents (i.e. copy utility bills or bank statements)
• Information about the deceased person

Under what circumstances may D&A Munn Ltd Funeral Directors contact me?

You have a choice about whether or not you wish to receive information from us. Our aim is not to be intrusive and we undertake not to ask irrelevant or unnecessary questions.

We may contact you regarding pre-payment plans or to invite you to leave a review of our service based on your experience with us.

We will not contact you for marketing purposes by email, phone, text message, Messenger, WhatsApp or post unless you have given your prior consent. You can change your marketing preferences at any time by telephoning us on 01631 562562 or by email to info@munns-oban.co.uk.

If you fail to provide personal information

If you fail to provide certain information when requested, we may not be able to perform the contract we have entered into with you or we may be prevented from complying with our legal or regulatory obligations. In such a situation we may no longer be able to proceed with your request or instruction or provide you with our services.

Change of purpose

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

Consent

By consenting to this privacy notice you are giving us permission to process your personal data specifically for the purposes identified. Where we ask you for sensitive personal data, e.g. medical information or religious beliefs, we will always tell you why and how the information will be used.

You may withdraw consent at any time by contacting us to update your preferences.

16 or Under

We protect the privacy of children aged 16 or under. If you are aged 16 or under, please get your parents/guardian’s permission beforehand whenever you provide us with personal information.

Disclosure

D&A Munn Ltd Funeral Directors will not pass on your personal data to third parties without first obtaining your consent.

The following third parties may receive your personal data for the following purposes:

• A local crematorium for the purpose of organising cremation of the deceased or ashes interment
• A local cemetery for the purpose of organising burial of the deceased or memorial requirements
• A nominated minister or celebrant for the purpose of arranging details of the funeral service and or memorial requirements
• A local musician for the purpose of liaising with you for your musical choices for the funeral service
• Local florist, caterer or technical specialist involved in providing services for the funeral
• Bereavement Group or Counsellor for additional bereavement support
• Debt recovery agencies and solicitors regarding non-payment of accounts

Retention period

D&A Munn Ltd Funeral Directors will process personal data for as long as is necessary to allow us to fulfil our services and will store the personal data indefinitely on our computer system and in paper format. Your personal information can be removed from our computer and filing system on request.

Your rights as a data subject:

At any point while we are in possession of or processing your personal data, you, the data subject, have the following rights:

• Right of access – you have the right to request a copy of the information that we hold about you.
• Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.
• Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.
• Right to restriction of processing – where certain conditions apply you have a right to restrict or stop the processing.
• Right of portability – you have the right to have the data we hold about you transferred to another organisation.
• Right to object – you have the right to object to certain types of processing such as direct marketing.
• Right to object to automated processing, including profiling – you also have the right to be subject to the legal effects of automated processing or profiling.
• Right to judicial review: in the event that D&A Munn Ltd Funeral Directors refuses your request under rights of access, we will provide you with a reason as to why.

If you would like a copy of the information held on you, please write to us directly. A small fee may be payable. If you believe any information we hold on you is incorrect or incomplete, please email or write to us as soon as possible. We will promptly correct any information found to be incorrect.

All of the above requests will be forwarded on should there be a third party involved (as stated above) in the processing of your personal data.

Security

In order to protect your personal information, we have put suitable physical, electronic and managerial procedures in place to safeguard and secure the information we collect about you and the deceased person in our care. These measures prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. Details of these measures are available upon request.

In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

Third parties will only process your personal information on our instructions and where they have agreed to treat the information confidentially and to keep it secure.

Transferring your information outside of the UK

As part of the services offered to you the information which you provide to us may be transferred to countries outside the UK. E.g. if it is necessary to repatriate your loved one home to the UK or in relation to our website, this may happen if any of our servers are from time to time located in a country outside the UK.

These countries may not have similar data protection laws to the UK. By submitting your personal data, you’re agreeing to this transfer, storing or processing of information. If we transfer your information outside of the UK in any way, we will take steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this policy.

If you use our services while you are outside the UK, your information may be transferred outside the UK in order to provide you with these services.
